A decision to hire a group of lawyers to contest the constitutionality of a state takeover of the school district was passed by MSCS board members on Tuesday night.
The school board’s action won’t matter though because Governor Bill Lee signed a bill on Tuesday night that would prohibit school districts from using public funds to sue the state over accountability measures, according to a Facebook post by state senator Brent Taylor.
The general assembly could vote on a bill on Wednesday that would authorize the state to have oversight of Memphis-Shelby County Schools.
Six of the six requirements for state intervention are met, according to the bill. These include low academics to findings in a forensic audit of the district, and pointing to evidence of mismanagement.
School board members said the state takeover is racist and unconstitutional and not about the children.
