After being called to court last year over her skeleton holiday décor, a Germantown woman filed a lawsuit against the city and won.
Before dressing them up for the holidays, Alexis Luttrell placed a skeleton and a skeleton dog in her yard in October.
She was notified in December that the décor was not in compliance with the city’s regulations.
Luttrell sued the City of Germantown federally in February, alleging that the city had violated her First and Fourth Amendment rights.
Attorneys for the resident claim that the city of Germantown agreed to a $24,999 compensation to resolve a First Amendment complaint and voted to remove its holiday ordinance.
“Not only am I no longer at risk of being fined for my skeletons, but the unconstitutional ordinance is now dead and buried,” Luttrell said after the settlement, “Today is a victory for anyone who has ever been censored by a government official and chose to fight back.”
